No, it can't. For this card's [On Play] [When Digivolving] effect, you chose 1 of your opponent's Digmon with no digivolution cards to gain "can't suspend or activate [When Digivolving] effects." The effect will continue affecting the chosen Digimon even if it later gets a digivolution card.

Yes, it triggers. If an effect's trigger conditions are met when the effect is gained, that effect will trigger. In this case, your opponent no longer has Digimon with digivolution cards at the same timing as when your opponent's Digimon is deleted in battle, therefore you can activate <Piercing>.
